MEDICAL CLEARANCE & SAFETY ADVICE
Medical Clearance:

Prior to commencing classes, you should consult with your medical care provider to determine if it will be an appropriate form of exercise for you based on your current health and medical history.

You must complete a pre-exercise medical questionnaire prior to commencing classes at Apex Pilates. You must not withhold any relevant details on this form. If any of the details on this form change, or new information arises, you will notify Apex Pilates without delay.

You should seek medical clearance if you have any symptoms and/or illnesses that may make it dangerous for you to participate in physical activities (including but not limited to heart conditions, stroke, high blood pressure, chest pains, fainting/dizziness, asthma, diabetes, muscle bone or joint problems etc).
Safety During Classes:

At the commencement of the class, you must notify your instructor if you have any relevant pre-existing injuries or medical conditions that may impact your safety in the class. This includes notifying them if you are pregnant or post-partum.

If at any time during your Pilates session, you experience a feeling of pain or discomfort, you should immediately stop the exercise and notify your instructor as soon as possible. Following the class, we recommend you seek medical advice and clearance before returning to exercise.

Our instructors are not able to provide medical advice or diagnosis. Any instructions, information or recommendations provided by Apex Pilates instructors, should not be interpreted as medical advice. When in doubt, we always suggest you consult your medical practitioner.

Apex Pilates and our instructors may recommend a specific class or in some cases restrict you to particular class types. Please understand class restrictions will only be undertaken for clear safety reasons, which will be explained to you wherever possible. Apex Pilates reserve to right to refuse entry to classes for the afore mentioned reason, in addition to clients without the required or requested medical clearance.

To prioritize your safety, you are required to arrive at the commencement of the class in order to complete the full warm-up portion of the session. Out of consideration for your instructor, other clients, and your own safety, if you arrive more than 5 minutes late for a class, you may be unable to participate.
KIDS ZONES
All children must be accompanied by a responsible adult who must remain on the premises and supervise the child/ren at all times. Instructors will not be responsible for supervising children.
If using the kids zone area you understand and agree to follow these rules to ensure the health and safety of all visiting children. Although every effort has been made to ensure a safe environment, we will not be held liable for any accident or injury that occurs whilst children are using the kids zone facilities.
Kids Zone Rules:

Parents and guardians are responsible for children and must remain on site at all times.

Kids must remain in the designated kids area, with safety gate closed. Unless they are non mobile or in pram.

Please don't bring your child if they are sick. This includes any fever or gastro symptoms within the last 48 hours.

Due to allergies and choking risk, no food or drink allowed (apart from water).
-
For hygiene reasons, please remove shoes before entering kids zone.

BOOKINGS, PAYMENTS & CANCELLATIONS
Bookings:
-
Class bookings, purchases and cancellations are to be made by the client on their personal account on our website via the Wellness Living widget or through the Wellness Living mobile app.

Payment is required at the time of booking. To book into a class time you must:
-Have a valid pre-purchased class pack
-Have a current membership
-Pay during the booking process
-
Please arrive on time for all classes, as you may not be able to join the class if warm-up has already commenced.
-
Please ensure you bring Pilates grip socks (available for purchase), a clean towel and water bottle for you to use during the session.
-
Classes are not transferable and cannot be used by anyone else other than the individual who made the booking.
-
All reformer classes are restricted to participants over 16 years of age. For members under 18, consent from your parent or guardian will be requested prior to commencing classes. During post-partum classes, infants or children who are not mobile are able to attend sessions with their parent/guardian. Children are to be supervised by parents at all times and Apex Pilates accepts no responsibility for the safety or supervision of children during these sessions.

Please be aware that classes and the instructors who take them are subject to change without notice. Apex Pilates reserves the right to modify or cancel classes if deemed necessary. However, we will endeavour to give you as much notice as possible of any class cancellations.

Class Cancellations:

To ensure fairness for our waitlisted clients, please provide as much notice as possible when cancelling. Our cancellation policy is:
-1 hours’ notice required before group classes
-6 hours’ notice required before studio classes
-
Please ensure you cancel or reschedule (via the website/booking app) before this cut-off to avoid forfeiting your class or incurring a $15 late cancellation charge (for memberships with unlimited weekly sessions). We understand sometimes unforeseeable circumstances can arise; however, we need to be fair and consistent with all clients, therefore no exceptions will be made.

Waitlists:

If a class you would like to attend has been fully booked, you can utilise the ‘waitlist’ function to automatically book into a spot if another client cancels and a space becomes available.
-
If you have selected ‘waitlist’ for a class, and a place becomes available, you will be notified by text and email that a spot has become available. You will need to select 'confirm' or 'cancel' on the waitlist notification email.
-
Out of respect for your fellow members on waitlists, please remove yourself from the waitlist ASAP if your availability changes and you will no longer be free to accept the place.

Gift Cards:

Gift Cards are non-refundable and non-transferable.
-
Gift cards are valid for 3 years. Gift cards will expire 3 months after the date of the first class booked using the gift card.
CLASS PACKS & MEMBERSHIPS

Intro Pass:
-
The Intro Pass is for new clients only and can only be purchased once
-
It is valid for 7 days and will commence/activate from the date of the first class booked.
-
Can only be used for group sessions (can NOT be used for studio or private sessions)
-
1 hour cancellation policy applies

The Introductory pass is non-refundable

This pass is non-transferable

Class Packs:

All class pack expiry dates commence from the date of purchase.
-5 Class Packs: 3 month expiry
-10 Class Packs: 6 month expiry
-20 Class Packs: 12 month expiry

Cancellation Policy: 1 hour notice for group/ 6 hour notice for studio or private sessions. If you cancel or change your booking later than this, you will forfeit the payment for that class.

Any classes that have not been used by the expiry date will be forfeited.

No extensions on expiry date available.

The Introductory pass is non-refundable

Apex Active Membership:

Access to 1 x reformer class per week

On this membership, additional reformer classes per week, can be purchased at the discounted $25 per session rate (normally $30 for a casual session)

Please ensure your banking and card details are up-to date and that funds are available, to ensure you do not incur any failed payments. Declined payments will be subject to a default charge of $4.40 per rejection (charged by payment processor).

Membership Perks:​

Bring a Friend For Free: If you have a friend who has not attended Apex Pilates before, you can bring them along to a session free of charge. First they will need to register online and complete the health questionnaire, then let us know their name and which session you will both be attending and we will add them to the class.

10% Off Products: Members will receive 10% off products both online and in-studio. This discount will be automatically applied in Wellness Living, however please remind the staff member of your discount if purchasing at reception. Please note: some product exclusions may apply.

Apex Pilates may collect, use, store, record and transmit your personal information entered on this website or provided to us. We commit that we will take reasonable steps to maintain the security of the information provided.

LIMITATION OF LIABILITY & INDEMNITY
By booking into a class at Apex Pilates or signing the below form, you agree that:

Whilst care has been taken by Apex Pilates, exercise is an inherently risky activity and by undertaking Pilates classes you have accepted this risk at your own discretion.

Apex Pilates classes may be physically strenuous and you voluntarily participate in them with full knowledge that there is a risk of property loss, personal injury or death.

You, your heirs, assigns or legal representatives fully release Apex Pilates (and its associated entities, directors, members, employees and contractors) from any claim, loss, damage or expense of any kind including in relation to personal injury, property damage, property loss or wrongful death, occurring at Apex Pilates, whether caused by negligence or otherwise.

Apex Pilates does not assume responsibility for any lost or stolen personal property. You acknowledge that Apex Pilates will not be held responsible in the event of loss, damage, unauthorized use, theft or injury resulting from and to any personal property that you bring within the Apex Pilates premises.

You acknowledge and agree that by booking into a class or attending Apex Pilates, you agree to the above terms and conditions and waive certain legal rights, including the right to sue in the circumstances set out above.

Governing Law
These Terms and Conditions are governed by the laws of the State of New South Wales, Australia, and the parties irrevocably submit to the exclusive jurisdiction of the courts having jurisdiction in the State of New South Wales, Australia, and the courts of appeal from them.
